Abstract:

Diplomová práce se zabývá problematikou na téma „Dědic v úpadku“. V návaznosti na mou bakalářskou práci na téma „Dědění ze závěti“ jsem se rozhodla pokračovat částečně tématikou týkající se dědického práva. Cílem práce je propojení dvou významných oblastí, a to práva dědického a insolvenčního. V praxi se stále častěji můžeme setkat s případy, kdy účastník řízení o pozůstalost je zároveň v úpadku, jelikož zákon tuto problematiku upravuje pouze ve dvou ustanoveních bylo pro mne toto zpracování výzvou. Čtenář zde bude obeznámen o základech práva dědického a taktéž insolvenčního se zaměřením na úpadek, zároveň zde bude poskytnuta syntéza postřehů, jenž vycházejí ze skutečných případů. Praktická část práce znázorňuje, zda jsou lidé plně obeznámeni s právní úpravou ohledně dědictví a úpadku. K získání veškerých podkladů jsem využila odbornou literaturu, internet a mnou vytvořené ankety. Zároveň jsem měla jedinečnou příležitost rozhovoru s respondentem, který si touto problematikou prošel a o jehož příběh se s jeho svolením prostřednictvím mé práce podělím. Přínos a výsledek diplomové práce by měly spočívat v obecném rozšíření povědomí z oblastí práva, kterou se tato práce zabývá.

Abstract:

The diploma thesis deals with the issue of "The Heir in Decline". As a follow-up to my bachelor's thesis on the topic "Inheritance from a will", I decided to continue partially with a topic related to inheritance law. The aim of the thesis is to connect two important areas, namely inheritance and insolvency law. In practice, we can increasingly encounter cases where the party to the estate proceedings is also bankrupt, as the law regulates this issue in only two provisions, this processing was a challenge for me. Here, the reader will be familiarized with the basics of inheritance and insolvency law with a focus on bankruptcy, at the same time a synthesis of observations based on real cases will be provided. The practical part of the work shows whether people are fully familiar with the legal regulation regarding inheritance and bankruptcy. I used specialist literature, the internet and surveys created by me to obtain all the documents. At the same time, I had the unique opportunity of interviewing a respondent who went through this issue and whose story I will share with his permission through my work. The contribution and result of the diploma thesis should consist in the general expansion of awareness of the areas of law that this thesis deals with.
