The importance of expert opinion and expert evidence for the needs of criminal proceedings

Abstract:

Má diplomová práce se zabývá v první řadě úlohou odborného vyjádření a znaleckého posudku pro potřeby trestního řízení, toho, co mají tyto dva instituty společného, v čem se liší, včetně zákonné právní úpravy. Ke správnému pochopení této problematiky je důležité také znát dokonale právní úpravu osoby znalce, jeho povinnosti a práva během řízení, samozřejmě jeho jmenování znalcem, jeho odměny i případné sankce za neplnění uložených povinností. Cílem této práce je tedy seznámení se se zákonnou úpravou a pochopení významu těchto dvou insitutů, včetně informací o znalecké činnosti ústavů a vytvoření si vlastního názoru na současnou právní úpravu. V úvodní části se zabývám definicí osoby znalce, jeho aktuální právní úpravou a samozřejmě podmínkami, co všechno je potřeba splnit, abychom se znalcem stali. Dozvídáme se tedy o tom, že znalec včetně znaleckého posudku a odborného vyjádření není upraven souhrnně v jednom právním předpise, ale že existuje úprava jak lex generalis, tak lex specialis, kterou použijeme vždy, když lex generalis s úpravou mlčí. Pokud už osoba splňuje zákonné podmínky pro jmenování znalcem, zabývám se jeho rozlišením na znalce zapsané v seznamu a znalce ad hoc. Další částí jsou možnosti odborných znalostí v trestním řízení, kde se už poprvé detailně zmiňuji o odborném vyjádření a snažím se ho komparovat se znaleckým posudkem. Následuje úloha znalce v praxi, to znamená jeho přibrání do trestního řízení, jeho kompetence, výslech, odměny i odvolání. Asi nejdůležitější a rozhodně nejrozsáhlejší část diplomové práce pojednává o znaleckém posudku, protože se během studia materiálů dovíme, že odborné vyjádření je upraveno naprosto minimálně, přičemž zákon často mlčí o tom, zda se tedy pro odborné vyjádření použije zákonná úprava znaleckého posudku, či nikoliv. U znaleckého posudku dokládám i malý historický exkurs, kde popisuji vývoj jeho úpravy a popisuji důležité změny, které vedly k dnešní úpravě a uvádím i přesné zákony, kterými byla poprvé problematika znaleckého posudku řešena a kdy ho bylo možné použít i u soudu. Následuje popis přípravy znaleckého posudku, jeho vypracování, zákonem požadované náležitosti, dále kategorizace, hodnocení znaleckého posudku a jeho možné vady. Ke konci práce se zabývám souhrnem zákonné úpravy jak znaleckého posudku, tak i odborného vyjádření, přičemž navrhuji některé změny ustanovení, kde jsou zřejmé díry v zákoně, a není jasné, jak postupovat, i přesto, že libovůle je zde nežádoucí. Cílem práce bylo tedy podat čtenáři komplexní informace o těchto institutech a zodpovědět všechny otázky, které se k tomuto tématu vážou.

Abstract:

My dissertation is first of all concerned with the task of expert opinion and expert evidence for the needs of criminal proceedings, in question what these two institutes have in common, how they are different, the legal legislation included. For right understanding of these issues is also important to know the legislation of expert´s person perfectly, his/her responsibilities and rights during proceedings, of course his/her appointment of Official referee, his/her rewards and potential sanctions against non-performance of his/her given responsibilities. The target of this dissertation is then informing about the legal adjustmet and understanding with the meaning of these two institutions, information about expert activities of these two institutions included and creating of own opinion to contemporary legislation . In the introductory part I am applying to the definiton of expert´s person, his/her topical legislation and of course to the conditions, what everything is necessary to fulfil to become an expert. We are learning that an expert included expert opinion and expert evidence is not adapted totaly in one legal statutatory instrument, but there is modification both lex generalis and lex specialis, which we use all the time when lex generalis with modification says nothing. If the person already fulfils legal conditions for an appointment to be an expert, I am applying to distinction for experts registred in the list and experts ad hoc. The next part are possibilities of expert knowledge in criminal proceedings where I am in detail refering fort the first time to the technical statement and I am trying to compare it with expert opinion. The task of expert in praxis follows, that means his/her acceptance at criminal trial, his/her qualifications, interrogation, rewards and appeals. Propably the most important and absolutely the most extensive part of the dissertation deals with expert opinion because during studying materials we will learn that expert opinion is adjusted absolutely minimally, at the same time the law often says nothing about it wheather it will be used for technical statement of legal adjustment of expert opinion or not. At expert evidence I gave the evidence of a small historical excursus, where I described the development of its legislation and important changes, which ones led to contemporary adjustment and I presented exact laws who solved problems for the first time and when it was possible to use them at the court. The description of preparing of expert evidence follows, its working out, by law required appropriateness, next categorizations, expert opinion rating and possible defects. At the end I am concerning with the summary of legislation both of expert evidence and technical statement, at the same time I suggest some changes of establishment, where are loopholes in the law obvious and it is not evident how to proceed despite the fact that arbitrariness is in this case undesirable. The target of this dissertation was then to report the readers global information about these institutes and answer all questions, which are fixed to this topic.
