Traffic accidents before and after the validity of the law Act No. 411/2005 CL

Abstract:

Cizojazyčné resumé Dopravní nehodovost je jedním z problémů novodobých dějin. Na silnicích a to nejen v České republice zemře ročně tisíce lidí. Společnost hledá nejrůznější formy, jak tomuto jevu zabránit a účastníky silničního provozu tak účinněji uchránit před následky, které z toho vyplývají. Nejčastěji volenou cestou, kterou nejen česká administrativa a legislativa volí, je předcházení dopravních nehod pomocí zákonných opatření. Je pravdou, že zákonné opatření, které bude do budoucna působit efektivně a preventivně, je cesta správná, ale je nutné si uvědomit, že prevenci je možné účinně vyvíjet pouze ve spolupráci s represí. Znamená to, že účastníky silničního provozu je možné vzdělávat, neustále připomínat, jak se mají na silnicích chovat, ale pokud nenastane účinné represivní opatření, bude prevence zcela zbytečná. Co to znamená v praxi? Je to jev, který v České republice převládá již od listopadu 1989. Represívní složka tj. policie ČR, ačkoliv hlásá, jak se snaží působit preventivně, prakticky má na řidiče vliv pouze represívní. Je to de facto jediná hrozba, která řidiči hrozí, jakkoliv si uvědomí, že právě páchá přestupek proti bezpečnosti a plynulosti silničního provozu, je pokuta uložená příslušníkem policie nebo orgánem s rozšířenou působností. Jakmile řidič páchá přestupek proti bezpečnosti a plynulosti silničního provozu, jedná samozřejmě zaviněně, ač je to zavinění úmyslné nebo z nedbalosti a z hlediska presumpce neviny není možné takového řidiče potrestat, jakmile mu nebude vina bez pochybností prokázána. Spousta řidičů tak spoléhá na to, že v době páchání jeho přestupku nejede okolo policejní vozidlo, které přestupek zachytí, zdokumentuje a vyřeší. Je to pro pachatele těchto přestupků jediná hrozba a tato je potřeba represi zvýšit, protože jak vidno, je to jediné řešení. Dokladem dobré prevence spojené se zvýšenou represí je fakt, že následně po účinnosti novely č. 411/2005 Sb., obrovským způsobem klesla nejen nehodovost, ale i zaviněné jednání řidičů ze strachu z toho, že mohou najednou za obyčejný přestupek přijít o řidičské oprávnění. Po nabytí účinnosti tohoto zákona represívní složky vyvíjely mnohem větší aktivitu ke zjišťování a potlačování tohoto druhu přestupků, než předtím, a mělo to svůj pozitivní účinek. Dle mého názoru by se budoucí legislativa ubírat tímto směrem a represívní složky by na taková zákonná opatření měla okamžitě zareagovat zvýšenou činností, ale zároveň zvýšenou připraveností, což dle mého názoru byl jeden ze zásadních problémů aplikace této novely do policejních složek

Abstract:

Resumé Traffic accident frequency is one of the problems of modern history. On the streets, and not only in Czech republic, die every year thousands of people. The society is looking for different forms how to avoid this phenomenon and how to protect the traffic participant more effectively against the results causing by this. The most frequently chosen way (chosen not only by the Czech administrative) is forerun the accidents by law regulation. It is truth the law regulation that will in the future act positively and preventively is the right way but is needed to consider the prevention is possible to make affectively only in the cooperation with the repression. This means the traffic participants is possible to educate, remind all the time how to act on the street but if there will not be any effectual repression the prevention will have no impact. What does this mean in praxis? It is a phenomenon that is in CZ already from November 1989. The repressive organ (police ČR) even says it is trying to act preventively, in praxis have only repressive influence on the driver. It is de facto the only one menace being upon the driver no matter how he take in account he is breaking the rules against the safety and fluency of the traffic, this is the fine given by the police officer or the authority with the spread competency. As soon as the driver causes the offence against the safety and fluency of traffic it is for sure intentional, no matter if caused intentionally or by negligence and from the point of view of presumption of innocence is not possible to correct such driver before the blame is not fully without any doubts proved. Many drivers so rely on no presence of police car during causing the offence that can catch, document and solve the offence. This is for the offenders of these offences the only danger so it is needed to increase the repression so as you can see this is the only one solution. The evidence of good prevention connected with the increased repression is the fact consequently after the force of the novelty No. 411/2005 Col. dramatically dropped not only the accident rate but even the behavior of the drivers caused by the fear of loosing the driving license at once for normal offence. After becoming in force of this law the repressive organs made much bigger activity for ensuring and suppressing this kind of offences than before and it had its positive impact. According to my opinion the legislative should go in this direction and the repressive organs should for such law actions react immediately by the increased activity but consequently with higher level of preparation which according to my opinion was one of the main problems of application of this novelty into police organs.
