The Limits of Necessary Defense and Extreme Necessity

Abstract:

Tato bakalářská práce se zabývá podmínkami užití nutné obrany a krajní nouze. Jelikož se jedná o okolnosti vylučující protiprávnost v trestním právu, tak první část práce je věnována pojmu trestný čin. Druhá část práce se zaměřuje na nutnou obranu a krajní nouzi z pohledu podmínek jejich užití a excesů. V práci se nachází také případová studie, která slouží k podrobnější analýze problematického aspektu nutné obrany. Poslední část práce se stručně zabývá ostatními okolnostmi vylučující protiprávnost, jako je svolení poškozeného, přípustné riziko a oprávněné použití zbraně. Jedna podkapitola je věnována i okolnostem v zákoně výslovně neuvedených. Cílem práce je za pomocí judikatury a analýz vymezit podmínky užití nutné obrany a krajní nouze.

Abstract:

This bachelor thesis deals with the conditions for the use of necessary defence and extreme emergency. Since these are circumstances excluding illegality in criminal law, the first part of the thesis is devoted to the concept of crime. The second part of the thesis focuses on necessary defence and extreme emergency in terms of the conditions of their use and excesses. The thesis also includes a case study which serves to analyse the problematic aspect of necessary defence in more detail. The last part of the thesis briefly discusses other circumstances precluding illegality, such as the victim's consent, permissible risk and legitimate use of the weapon. One subchapter is also devoted to circumstances not explicitly mentioned in the law. The aim of the thesis is to define the conditions for the use of necessary defence and extreme necessity by means of case law and analysis.
