Asylum Procedure in the Territory of the Czech Republic and its Financing by the Administration of Refuge Facilities of the Ministry of Interior of the Czech Republic

Abstract:

V úvodní části diplomové práce rozebírám fenomén migrace a uprchlictví na území České republiky a právní úpravu v oblasti mezinárodní ochrany, kterou je Česká republika vázána. Poté se zabývám průběhem azylové procedury na našem území, a to od prohlášení cizince o úmyslu požádat Českou republiku o mezinárodní ochranu, přes pobyt žadatele o mezinárodní ochranu v azylových zařízeních, a také průběhem řízení o udělení mezinárodní ochrany formou azylu. Tento celý proces se neobejde bez finančních prostředků, proto se v další části zabývám Správou uprchlických zařízení Ministerstva vnitra České republiky, která vše zastřešuje. V poslední části popisuji slabá místa v azylové proceduře a navrhuji možné legislativní, ekonomické a procesní změny, vedoucí ke snížení nákladů na azylovou proceduru a tak ke zlepšení situace na poli mezinárodní ochrany.

Abstract:

The introductory part of this dissertation I analyse the phenomenon of the migration and refugees in the territory of the Czech Republic and the legal regulations by which is the Czech Republic obliged in the area of an international protection. Further I concern on the development of the asylum procedure in our territory, starting from a declaration of a foreigner about an intention to ask the Czech Republic for an international protection, to the period of the stay of an applicant for international protection in the asylum facility, and also keeping in mind the development of the asylum procedure. This whole process also requires financial resources, therefore in the next part I inform about the activities of the Administration of the Refugee Facilities of the Ministry of Interior of the Czech Republic, which supports the whole process. In the last part I describe weak spots in the whole asylum procedure and I suggest legislative, economy and procedural changes to reduce the asylum procedure costs and also some improvements of the situation in the field of the international protection.
