Community property of spouses

Abstract:

This bachelor thesis named Community Property of Spouses deals with and analyzes the content of this legal subject. The aim of this theses is to narrow the subject of the Community Property of Spouses, its significance and questions regarding its settlement with the emphasis on the problematic area of the settlement of a business share. The thesis is divided into 3 consequent chapters, each consisting of subchapters and subdivisions. First chapter theoretically describes marriage as a fundamental prerequisite for the creation of the community property of spouses. We learn more about various forms of conclusion of a marriage, premarital contract, as well as legal system and the nature of joint ownership in the subchapters. In the second chapter we analyze the modification of the community property of spouses, its range, termination and settlement. Third and the last chapter focuses on a recent problem of the settlement of community property of spouses and its relationship to business share.

Abstract:

Táto bakalárska práca s témou Bezpodielové spoluvlastníctvo manželov rozoberá a analyzuje problematiku tohto právneho inštitútu. Cieľom tejto práce je pohľad na problematiku bezpodielového spoluvlastníctva manželov, na jeho význam a otázky súvisiace s jeho vyporiadaním s akcentom na problematickú oblasť vyporiadania obchodného podielu. Práca je rozdelená do troch nadväzujúcich kapitol. V prvej kapitole je teoreticky vymedzené manželstvo ako základný predpoklad pre vznik BSM. V podkapitolách sa dočítame o formách uzavretia manželstva, o predmanželskej zmluve, ale taktiež o právnom systéme a povahe spoluvlastníctva. V druhej kapitole analyzujeme modifikáciu BSM, ako aj rozsah, zánik a následné vyporiadanie. Tretia a zároveň posledná kapitola pojednáva o probléme, ktorý je v dnešnej dobe veľmi aktuálny. Hovoríme o vyporiadaní bezpodielového spoluvlastníctva manželov vo vzťahu k obchodnému podielu.
