Abstract:

V první kapitole uvádím definici právního úkonu, zmiňuji se o jeho druzích a dále popisuji a charakterizuji nutné náležitosti právního úkonu, na konci kapitoly rovněž hovořím o právním jednání. Druhá kapitola se týká absolutní a relativní neplatnosti, zde představuji hlavní znaky obou koncepcí, nastiňuji jejich historický vývoj, dále pak výhody i nevýhody obou přístupů a to, čím se od sebe vzájemně odlišují. Třetí kapitola pojednává o pojmu exekuce, uvádím v ní, jaké druhy exekucí český právní řád zná a co je pro ně určující, ke konci kapitoly jsem si dovolil krátkou zmínku o dopadu rozsáhlé novely exekučního řádu, která nabyla účinnosti v mezidobí od zvolení tématu práce do jejího odevzdání. Čtvrtá kapitola je zaměřena na průběh exekučního řízení se zmínkou o účinnosti jednotlivých inhibitorií pro povinného. V páté kapitole se rozepisuji o právních úkonech povinného, jejich absolutní a relativní neplatnosti, procesních institutech generálního a speciálního inhibitoria, popisuji vývoj obou institutů v běhu času a snažím se zamyslet nad problémy a nejasnými situacemi, které v praxi již nastaly nebo které mohou v souvislosti s oběma zákazy v praktickém životě teprve nastat, zaměřuji se též na možné obejití obou institutů povinným. Poslední kapitolu zakončuji objasněním dalšího procesního institutu, kterým je arrestatorium.

Abstract:

In the first chapter the definition of a legal act , refers to the species and its further describe and characterize the necessary requisites of a legal act , the end of the chapter also speak of the legal proceedings.  The second chapter concerns the absolute and relative nullity , here I present the main characteristics of both concepts , I outline the historical development , as well as the advantages and disadvantages of both approaches and what makes them differ from each other .  The third chapter deals with the concept of execution, mention it , what types of foreclosures Czech legal order and knows what is best for them, indicating the end of the chapter, I ventured a brief mention of the impact of extensive amendment to the Enforcement Regulations, which came into effect in the period between the election of the work, in its submission .  The fourth chapter focuses on the course of enforcement proceedings with reference to the effectiveness of individual inhibitorií the principal.  In the fifth chapter expands upon the statutory legal acts , their absolute and relative nullity process Institutes of General and Special inhibitoria , describe the development of both institutions in the course of time and I try to think about the problems and unclear situations , which in practice has arisen or which may arise in connection with both prohibitions in real life yet to come , my focus is also possible to circumvent both institutes mandatory . The last chapter ended further clarification of the procedural Institute, which is arrestatorium .
