Organized Crime Committed Against Endangered Species Under CITES

Abstract:

Magisterská práce se zabývá problematikou organizovaného zločinu páchaného na ohrožených druzích dle CITES. Má práce zkoumá předmět páchané trestné činnosti, kdo je jejím pachatelem a možné motivy vedoucí pachatele k páchání trestné činnosti na úmluvou chráněných druzích. Zkoumá vývoj trestné činnosti od samotného úmyslu páchat trestnou činnost na ohrožených druzích, zahájení trestního řízení, průběh vyšetřování, dokazování, vzájemnou součinnost s orgány zabývající se ochranou ohrožených druhů dle CITES mezi sebou, spolupráci se státními zástupci a soudy, případně i komunikaci se zahraničními složkami. V praktické části mojí práce byla zvolena metoda řízených rozhovorů se zástupci orgánů, které se na problematice ochrany ohrožených druhů dle CITES přímo podílejí. Otázky pro řízený rozhovor vychází z poznatků nabytých z teoretické části. Otázky jsou pokládány každému zástupci daného orgánu individuálně a dotýkají se zkoumané oblasti. Cílem mé diplomové práce je zhodnocení postupu Celní správy České republiky při vyšetřování organizovaného zločinu páchaného na ohrožených druzích dle CITES, zhodnocení provázanosti a předávaní informací s ostatními kompetentními orgány v rámci České republiky, ale také se zahraničními kolegy. Výstupem mé práce je ucelený popis pachatelů organizovaného zločinu a jejich možný výskyt a dále pak návrh řešení, který by eliminoval organizovanou kriminalitu páchanou na ohrožených druzích dle CITES.

Abstract:

The Master´s thesis addresses the issue of organized crime perpetrated against endangered species according to CITES. My thesis examines the nature of the criminal activities, the identity of the perpetrators, and the potential motives driving them to commit crimes against species protected by the Convention. It explores the evolution of criminal activities from the initial intent to commit crimes against endangered species, through the initiation of criminal proceedings, the course of investigation, the process of gathering evidence, collaboration with CITES authorities responsible for the protection of endangered species, cooperation with prosecutors and courts, and, where applicable, communication with foreign entities. In the practical section of my thesis, I employed the method of structured interviews with representatives of authorities directly involved in the protection of endangered species under CITES. The questions for these interviews are derived from insights gained in the theoretical section and are tailored to each representative, focusing on their specific area of expertise. The goal of my thesis is to assess the procedures of the Customs Administration of the Czech Republic in investigating organized crime targeting endangered species according to CITES, as well as to evaluate the coordination and exchange of information with other relevant authorities within the Czech Republic and abroad. The outcome of my research is a comprehensive depiction of organized crime perpetrators and their potential presence, accompanied by proposed solutions aimed at eliminating organized crime against endangered species according to CITES.
