Abstract:

V posledních letech dochází k negativním dopadům migrační vlny, která odsouvá pozitivní stránky migrace vůbec. Za uplynulé měsíce došlo v rámci přílivu uprchlíků, kteří se dostali do Evropské unie, k řadě problémů jako jsou sílící teroristické útoky, které v nás vyvolává emoční rozpoložení. Samotná Evropa si uvědomuje, že přijetí takového množství migrantů představuje bezpečnostní rizika. Snaha EU s vyrovnáním se s touto vlnou uprchlíků vyvolává i řadu negativních reakcí. Jedním z negativ, které vnímají některé státy EU jako zásah do samostatného a svobodného rozhodování států, je stanovení povinných kvót týkající se členských států EU. V rámci Evropské unie se občan některého z členských států automaticky stává občanem EU. Toto občanství je pouze doplňujícím prvkem státního občanství a společně se získanými výhodami plynoucími z občanství EU např. právě právem svobody pohybu a pobytu, ale přináší i určité povinnosti, na které bychom neměli zapomínat. Tato bakalářská práce je zaměřena na občany EU a jejich rodinné příslušníky. To souvisí i se samotným pobytem těchto cizinců na území ČR a úskalím, které se snaží překonat v rámci jejich pobývání na území. Jde o přechodný pobyt a trvalý pobyt a podmínek v rámci platného zákona o pobytech cizinců, které jsou vyžadovány k získání pobytových statusů. Autorka se pokusila přiblížit podmínky, které jsou vyžadovány zákonem po žadatelích o pobyt na území ČR, aby se i pro ostatní, nejen pro cizince, ale i pro laickou veřejnost staly srozumitelnější a ve své podstatě pochopitelnější.

Abstract:

In recent years, the negative impact of migration waves, which postponed all of the positive aspects of migration. Over the past month have occurred within the influx of refugees, who arrived into the ranks of the European Union, such as rising terrorist attacks that make us different emotional state. Europe itself is aware that the adoption of such numbers of migrants poses a security risk. The EU’s attempt to cope with the wave of refugees raises a number of negative reactions. One of the negatives that perceive some EU countries as interference in self-determination and an independent State, is setting mandatory quotas for the EU Member States. Within the European Union, a citizen of a Member State automatically becomes a citizen of the EU. This citizenship is only a complementary element of citizenship and, together with the advantages derived from EU citizenship, for example. Just right to freedom of movement and residence, but also brings certain obligations, which we should not forget. This thesis is focused on EU citizens and their family members. It is also related to the actual residence of these foreigners staying in the Czech Republic and pitfalls that are trying to overcome their residing within the territory. It is a temporary residence and permanent residence and conditions within the residing valid Aliens Act, which is requered to obtain residence status. The author tried to approach the conditions that are required by law applicants for residence in the Czech Republic to be for others, not only for foreigners but also for the general public become more understandable and inherently understandable.
