Immediate Termination of Employment Due to Criticism of the Employer

Abstract:

Práce je věnována problematice okamžitého zrušení pracovního poměru z důvodu kritiky zaměstnavatele, a to především na sociálních sítích. Autor se za použití vědeckých metod zkoumání nejprve zabývá oprávněností kritiky a na základě analýzy právních norem a aktuální judikatury zkoumá, zda tato může být považována za jednání v rozporu s oprávněnými zájmy zaměstnavatele. Výsledkem této práce je pak vymezení podmínek, při jejichž kumulativním naplnění lze považovat kritiku zaměstnavatele za důvod pro okamžité zrušení pracovního poměru, a to i tehdy, je-li tato kritika pronesena na sociálních sítích.

Abstract:

This thesis concerns the immediate termination of employment when there is a criticism of the employer, especially on social networks. The author uses scientific methods of research to find out if any kind of criticism would have been considered as an infringement of the legitimate interests of the employer. The aim of this work is to define which conditions need to be cumulatively fulfilled to possibly consider the criticism as a reason for the immediate termination of employment.
