Abstract:

Abstrakt Předložená diplomová práce se zabývá tématem přestupkového řízení. Jedná se o velice obsáhlou problematiku, na kterou se kromě řady dalších právních předpisů vztahuje relativně nový zákon č. 250/2016 Sb., o odpovědnosti za přestupky a řízení o nich, ve znění pozdějších předpisů. Tento zákon zavádí oproti původní právní úpravě do dané problematiky i značné množství nových institutů, a proto je obsah diplomové práce zaměřen zejména na definici základních pojmů souvisejících s řízením o přestupcích, prameny, které se na něj vztahují, na postup před zahájením řízení, zahájení řízení a vymezení okruhu subjektů řízení. Dále věnována pozornost průběhu samotného řízení se zaměřením na ústní jednání, shromažďování podkladů k rozhodnutí, provádění a hodnocení důkazů a rozhodnutí. Stěžejní část diplomové práce se věnuje novinkám, které do problematiky přinesl nový zákon. Cílem diplomové práce je poukázat na problémy při aplikaci nových institutů, které přinesl nový zákon, v praxi správního orgánu a nastínit jejich možné řešení.

Abstract:

Abstract The present thesis examines issues relating to the prosecution of minor offenses. Because of the extensive nature of this topic, which, moreover, is subject to various laws, including the relatively recent Act No. 250/2016 Coll. on Liability for Minor Offenses and Prosecution of Minor Offenses, as in effect, which has introduced a large number of new legal concepts vis-à-vis the original legislation, issues relating to this topic cannot be examined in their entirety within the scope of a single thesis. For this reason, the thesis mainly focuses on defining general terms relating to the prosecution of minor offenses, the applicable information sources, procedures preceding the beginning of proceedings, the launch of proceedings, definition of parties subject to proceedings, and, most importantly, the progress of proceedings, where attention is focused on verbal hearings, collection of data, the collection and evaluation of evidence, and the delivery of a judgment. The key part of the thesis focuses on new concepts introduced by the aforementioned recently adopted law. The objective of the thesis is to point out problems with the application of the new legal concepts introduced by the new act in real-world situations dealt with administrative authorities and to suggest possible solutions.
