Jurisdiction of Courts for Private Claims Arising from a Breach of Competition Law
Abstract:
Cílem této práce bylo zjistit, jakým způsobem budou aplikovány normy určující pravomoc soudů v nařízení Brusel I na různé typy soukromoprávních žalob vyvolaných porušením soutěžního práva. Autor dovodil, že ve většině klíčových případů nebude mít žalovaný téměř žádnou šanci předvídat zemi (fórum), ve které bude žaloba proti němu podána. Žalobce má možnost „forum shopping“.
Abstract:
This thesis is focused specifically on how the Jurisdiction Regulation (Brussels I) can be applied to complex cases of private enforcement of Competition Law (national and European), including both contractual and tort claims.
