Counterfeiting and Reproduction of Money

Abstract:

Tato bakalářská práce se zabývá paděláním a rozmnožováním peněz z pohledu trestního práva, Evropské unie a dále se bude zabývat odpovědností za padělání a rozmnožování peněz. Práce se bude také věnovat padělání a rozmnožování peněz všeobecně hlavně jaké má ochranné prvky proti padělání a rozmnožování koruna a jaké má euro, jak se dělí padělky podle nebezpečnosti atd. V práci se budu věnovat i finanční kriminalitě a praním „špinavých“ peněz, protože to úzce souvisí s paděláním a rozmnožováním peněz, a to jak z pohledu trestního práva v České republice, tak z pohledu Evropské unie. Dále bude práce zaměřena na Evropskou měnovou unii, kde bude rozebráno, jak to je s pravomocemi v oblasti odpovědnosti za padělání a rozmnožování peněz, na některé zakládající smlouvy Evropské unie, které byly zaměřeny na měnu a na trestné činy proti měně a platebním prostředkům, jako jsou praní špinavých peněz, padělání a rozmnožování peněz atd. Tato závěrečná práce by měla být napsána, aby objasnila otázky ohledně nadnárodních limitů pro jednání proti měně a platebním prostředkům. Cílem této práce je tedy odpovědět na otázky: a) zda Evropská unie stanoví nadnárodní limity pro jednání proti měně a platebním prostředkům a zda tomu tak je: b) jakým způsobem tyto limity Evropská unie stanoví a dále pak odpovědět na otázku: c) zda se tyto limity týkají padělání a rozmnožování peněz. Práci mám v plánu vypracovat jako práci teoretickou (výzkum kvantitativní) s použitím metody analýzy a syntézy u trestných činů proti měně a platebním prostředkům a u některých nařízení a směrnic Evropské unie. Dále budou v práci použity metody dedukce a indukce.

Abstract:

This bachelor thesis deals with money counterfeiting and reproduction of money from the point of view of the criminal law and the European Union. It further deals with responsibility for money counterfeiting and reproduction of money. The thesis will also focus on money counterfeiting and reproduction of money in general. In particular, the protection elements against counterfeiting and reproduction of the crown and the euro will be tackled. The thesis also describes how counterfeits are divided according to threats, etc. The thesis deals with financial crime and money laundering, as these are closely related to money conterfeiting and reproduction of money, both from the point of view of the criminal law in the Czech Republic and the law of the European Union. Furthermore, the thesis focuses on the European Monetary Union and discusses its responsibility powers in terms of money counterfeiting and reproduction of money. Some founding treaties of the European Union which focus on currency, currency crimes and means of payment such as money laundering, money counterfeitign and money reproduction, etc. are stated. This bachelor thesis should clarify the questions about supra-national limits on acting against currency and means of payment. Therfore, the aim of this thesis is to answer these questions: (a) whether the European Union sets supra-national limits on acting against currency and means of payment and whether that is the case: (b) how the European Union sets these limits and then answer the question: (c) whether these limits relate to counterfeiting and reproduction of money. The thesis is theoretical (quantitative research) using the method of analysis and synthesis for currency related crimes and crimes against means of payment and for certain regulations and directives of the European Union. In addition, methods of deduction and induction are used.
