Transfer of Powers and State Sovereignty: Constitutional Aspects of European Integration

Abstract:

Tato práce je zaměřena na problematiku přenosu pravomocí a suverenity státu, která je aplikována na vstup a následné členství České republiky v Evropské unie. Po úvodním vymezení pojmu suverenity státu a historickém ohlédnutí za teoriemi suverenity se práce věnuje modernímu pojetí suverenity včetně postoje Ústavního soudu České republiky k této problematice. Základní otázkou této práce je ověření existence tzv. "tvrdého jádra suverenity", tedy pravomocí, které stát nemůže přenést na jinou entitu, aniž by došlo ke ztrátě jeho suverenity. Na otázku "tvrdého jádra suverenity" částečně odpověděl německý Spolkový Ústavní soud ve své judikatuře, která je v této práci rovněž zpracována. V další pasáži je vymezena relevantní právní úprava, která umožnila vstup České republiky do Evropské unie, včetně komentářů odborné veřejnosti. Právní úpravu a otázku suverenity státu doplňuje aktuální judikatura Ústavního soudu České republiky. Předposlední část této práce je věnována charakteristice Evropské unie, její zvláštní povahy včetně vymezení rozdílů mezi mezinárodní organizací, konfederací a federací, otázky sdílené suverenity, materiální ústavy Evropské unie a otázky možného vystoupení z Evropské unie. Konečně poslední část této práce je zaměřena na pravomoci Evropské unie, teorii implicitních pravomocí a funkčních ustanovení včetně charakteristiky vybraných politik Evropské unie a jejich změn po přijetí Lisabonské smlouvy.

Abstract:

This thesis describes the question of transferring powers and sovereignty of state, which is applied to entering and consequent membership of Czech Republic in European Union. After the initial definition of the term sovereignty of state and historic aspects of theories of sovereignty the thesis deals with modern concepts of sovereignty including attitude of The Constitutional Court of the Czech Republic to these issues. The main question of this thesis was to verify existence of "The Hard Core of Sovereignty", powers which cannot be transferred to any other entity without loosing its sovereignty. The question of "The Hard Core of Sovereignty" was partly answered by The Federal Constitutional Court in its case law, which makes also a part of this thesis. In next passage there is specified relevant legislation that enabled entering Czech Republic to European Union including commentaries of Czech professional public. Legislative and the question of sovereignty of state are equipped with current case law of The Constitutional Court of the Czech Republic. Penultimate part of this thesis describes the characteristic of European Union, its special character, including differences between international organization, confederation and federation, question of pooled sovereignty, Material Constitution of the European Union, and questions of possible withdrawal from the European Union. Finally the last part is focused on powers and competences of European Union and questions of possible withdrawal from the European Union, theory of implied powers and functional provisions including selected policy of the European Union and its changes after acceptance of The Lisbon Treaty.
