Indirect Discrimination in the Case Law of Czech courts. Philosophical-Legal Analysis of the Problem.

Abstract:

Tato diplomová práce se zabývá analýzou pojetí nepřímé diskriminace v judikatuře českých soudů. Výklad některých znaků této formy diskriminace činí českým soudům potíže. V důsledku toho nejsou schopny v určitých případech nepřímou diskriminaci identifikovat. Práce je rozdělena do pěti kapitol, v nichž je blíže představena definice nepřímé diskriminace, její právní úprava a především analýza a komparace jednotlivých judikátů českých a mezinárodních soudů, které se týkají specifik výkladu některých jejích znaků. Na základě zjištěných skutečností jsou navržena možná řešení, jak by měly české soudy znaky nepřímé diskriminace interpretovat.

Abstract:

This diploma thesis deals with the analysis of the concept of indirect discrimination in the case law of the Czech courts. Czech courts have difficulty in interpreting some features of this form of discrimination. As a result, they are unable to identify indirect discrimination in certain cases. The thesis is divided into five chapters, which introduces the definition of indirect discrimination, its legislation and especially the analysis and comparison of individual judgments of Czech and international courts, which relate to the specifics of the interpretation of some of its features. Based on the findings, possible solutions are proposed for how Czech courts should interpret the features of indirect discrimination.
