Abstract:
Bakalářská práce se zabývá definicí znásilnění. Uvádí základní záležitosti, znaky skutkové podstaty. Dále udává historickou komparaci, která předcházela vývoji právní normy. Vymezuje pojem konsenzus a jeho podmínky. Blíže popisuje podvodné zná-silnění a související pojmy „fraud in factum“ a „fraud in inducement“. Práce polemi-zuje nad správností české právní úpravy.
Abstract:
The bachelor thesis deals with the definition of rape. It presents the basic issues, the features of the facts. It also gives a historical comparison that preceded the devel-opment of the legal norm. It defines the concept of consensus and its conditions. It describes fraudulent rape and the related terms "fraud in factum" and "fraud in inducement" in more detail.
