Legal Regulation of Guardianship de lege ferenda

Abstract:

Diplomová práce pojednává o institutu poručenství de lege lata s důrazem na změny, které nastaly k 1. 1. 2014, díky rekodifikaci soukromého práva. V souvislosti s poručenstvím, práce srovnává úpravy vybraných zahraničních států a zahrnuje úpravu tohoto institutu v rámci Evropské unie a Komise pro evropské rodinné právo. Nedílnou součástí diplomové práce jsou náměty de lege ferenda, které jsou zahrnuty v průběhu celé práce, avšak hlavní koncept tzv. porodní formulář spolu s dalšími úvahami autorka vymezuje na závěr.

Abstract:

The thesis deals with legal guardianship de lege lata with the emphasis on the changes that were implemented on 1st January 2014, due to the recodification of Private law. Concerning the guardianship, the thesis compares the modifications of selected foreign countries and includes the modification of this institute within the European Union and the Commission on European Family Law. The thesis also includes the suggestions de lege ferenda, which are integrated throughout the thesis, nevertheless the main concept, so called birth form, and other reflections are defined by the author at the end of the thesis.
