Abstract:

Spory řešené v mezinárodním rozhodčím řízení nabývají v současné době na komplexitě. Tato práce si klade za cíl probádat možnosti projednání více nároků z více smluv v rámci jediného rozhodčího řízení. Normativním základem jsou autorovi Pravidla ICC z roku 2012. Otázka je řešena jak pro situaci, kdy více smluv obsahuje jednu rozhodčí doložku, tak pro situaci, kdy je v rámci více smluv přítomno rozhodčích doložek více. Autor dále zohledňuje i případné meze dané národními právními řády.

Abstract:

The disputes resolved in international commercial arbitration are becoming more and more complex nowadays. This thesis aims to elaborate on whether one may hear multiple claims from multiple contracts in one single set of proceedings. The 2012 ICC Rules serve as the normative basis. The issue is examined for the situation where there are more contracts with one arbitration agreements, as well as the situation where there are multiple contracts with multiple arbitration agreements. The author further takes also the boundaries set by the national legal orders into account.
