Defense and Right to a fair trial

Abstract:

Práce popisuje vývoj jednotlivých práv tvořících v souhrnu právo na spravedlivý proces. Poukazuje na právní prameny, kterými se pokoušeli dožádat svých základních práv a svobod občané v různých historických dobách a různých zemích (Anglie, Francie, USA). Dále uvádí aktuálně užívané a platné prameny práva, a to jak na úrovni mezinárodní (Úmluva o ochraně lidských práv a základních svobod, Listina základních práv Evropské unie), tak i na úrovni vnitrostátní či zákonné (Ústava České republiky, Listina základních práv a svobod, Trestní řád a trestní zákon). V práci je vysvětleno, jak jsou v těchto dokumentech chápány jednotlivé dílčí zásady a práva spravedlivého procesu dnes. Práce obsahuje podrobný rozbor každé takové zásady, práva či principu, s ohledem na výklad judikatury ESLP, tak i judikatury Ústavního soudu České republiky, vztahující se k dané problematice a celkově je zpracována z oblasti odvětví trestního práva a z hlediska trestního řízení. Práce obsahuje v poslední kapitole případy z praxe, v nichž došlo právě k porušení dílčích práv spravedlivého procesu, shrnutí důvodů a okolností, které nebyly dopředu soudy předpokládány a s jakými argumenty na tato případy pohlížely soudy České republiky (vyjma jednoho případu z Finska).

Abstract:

This thesis describes the development of individual rights, which together constitute the right to fair trial. It refers to the legal parameters through which citizens in various historical eras and various countries (England, France, USA) strove to uphold their basic rights and liberties. It also lists the currently used and valid sources of law, both on an international level (Convention on the Protection of Human Rights and Basic Freedoms, Charter of Basic Rights of the European Union), and on a national or legislative legal (Constitution of the Czech Republic, Charter of basic Rights and Freedoms, Criminal Code and Penal Code). The thesis explains how the individual partial principles and rights of fair trial contained in these documents are understood today. The work contains a detailed analysis of every such principle or right, with regard to the interpretation of the European Court of Human Rights case law, as well as the case law of the Constitutional Court of the Czech Republic, pertaining to the given issue, and is compiled mainly from the area of criminal law and in terms of criminal prosecution. In the final chapter, the thesis contains examples from practice, in which the partial rights to fair trial were violated, a summary of the reasons and circumstances which were not foreseen by the courts, and the arguments with which the courts of the Czech Republic approached these cases (except for one case from Finland).
