Unauthorized construction of engineering networks on foreign land

Abstract:

Předložená bakalářská práce se zabývá problematikou staveb inženýrských sítí postavených v období komunismu v rozporu s tehdejší právní úpravou. Cílem bakalářské práce je zpracovat případovou studii zvolené stavby inženýrské sítě. Metody výzkumu spočívaly na komparaci vývoje vlastnických práv a vymezení pojmů staveb oprávněných a neoprávněných v části teoretické s části praktickou, kde byla aplikována aktuální právní úprava a judikatury z rozhodovací praxe Nejvyšších a Ústavních soudů. Těžiště výzkumu spočívá v nalezení vhodných řešení vyplývající z kolizních situacích mezi vlastníkem pozemku a vlastníkem vodního díla v souvislosti s rekodifikací soukromého práva. Principiálním aspektem je analýza aplikovatelnosti negatorní žaloby a náhrada za věcné břemeno podle § 59a vodního zákona v kontextu neoprávněné stavby.

Abstract:

The submitted bachelor's thesis deals with the issue of utility network constructions built during the communist era in violation of the then legal regulations. The aim of the bachelor's thesis is to prepare a case study of the chosen engineering network construction. The research methods were based on the comparison of the development of property rights and the definition of the concepts of authorized and unauthorized buildings in the theoretical part with the practical part, where current legislation and jurisprudence from the decision-making practice of the Supreme and Constitutional Courts were applied. The focus of the research lies in finding suitable solutions resulting from conflict situations between the owner of the land and the owner of the waterworks in connection with the recodification of private law. The principle aspect is the analysis of the applicability of the negative action and § 59a of the Water Act in the context of unauthorized construction.
