Prohibition of the use of force in international law

Abstract:

Diplomová práce s názvem „Zákaz použití síly v mezinárodním právu“ pojednává o použití síly a jeho omezování v mezinárodním prostředí. Práce je rozdělená do tří hlavních částí. První část se věnuje formování myšlení o omezení použití síly v mezinárodních vztazích v průběhu historie. Zabývá se myšlenkami a uvažováním nad tématem použití síly a jeho omezení. Rovněž vysvětluje válku z právního i etického rámce. Je zde i zmapována cesta vedoucí ke zformování současného systému bezpečnostních smluv. Následující část práce se věnuje samotnému použití síly v mezinárodním právu. Tato pasáž je velké části vedena výkladem Charty OSN. Vysvětluje, jakým způsobem se Charta staví k použití síly. Je zde popsán současný systém smluv, který by měl vyloučit válku jako normální interakci mezi státy. Tato část rovněž vysvětluje legální použití síly, a jakým způsobem by mezinárodní systém měl reagovat na ilegální použití síly. Třetí a poslední částí jsou pak tři rozdílné případové studie. Na každé z nich je znázorněno a vysvětleno odlišné použití síly, a pokud se jednalo o ilegální použití síly, jaké následky z toho pro agresora vzešly.

Abstract:

The diploma thesis Prohibition of the Use of Force in International Law deals with the use of force and its restriction in the international environment. The work is dividend into three main parts. The first part is about forming thinking about limiting the use of force in international relations throughout history. It deals with thoughts and reflections on the topic of the use of force and its limitations. It also explains the war from legal and ehtical framework. There i salso moped path leading to the formativ of the current system of security treaties. The following part of the thesis deals with the use of force in international law. This passage is largely based on explanations of the UN Chart. It explains how the Charter approaches the use of force. It describes the current systém of treaties which should exclude war as a normal interaction between states. This section also explains the legal use of force and how the international systém should reskond to the illegal use of force. The third and the last part contains three different case studies. Each of them shows and explains the different use of force and i fit was an illegal use of force, shows the consequensces, which affected agresor.
