Abstract:

Předmětem bakalářské práce „Ochranná známka“ je popis a seznámení této tématiky v širších souvislostech. V první části se věnuji teoretickým základům z oblasti ochranných známek a především pak jejich samotným vymezením, popisem hlavních funkcí a současnou právní úpravou. Druhá část je věnována nekalé soutěži a jednotlivým skutkovým podstatám nekalosoutěžního jednání. V rámci dané problematiky, které se věnuji, je pozornost zaměřena především na taková jednání v nekalé soutěži, která přímo souvisí s tématem ochranných známek. Závěrečná kapitola je pak předmětem analýzy současného stavu v ochraně práv duševního vlastnictví a představení důsledků, ať už ekonomických, tak i společenských, které z příčin porušování práv z duševního vlastnictví vznikají. Z hlediska vlastního zanalyzování této problematiky jsem se soustředil zejména na činnost kontrolních orgánů v oblasti ochrany práv duševního vlastnictví, která napomáhá ke zlepšení situace v oblasti porušování práv duševního vlastnictví.

Abstract:

Bachelor thesis subject of „trade mark“ is the description and identification of this subject in a broader context. The first part deals with theoretical foundations of the trade marks, especially the actual definition, description of the main functions and the current legislation. The second part is devoted to unfair competition and the individual merits of unfair competition. As part of the issue to be doing, attention is focused primarily on such practices in unfair competition, which is directly related to the topic of trade marks. The final chapter is then analyzed the status quo in the protection of intellectual property and performance consequences, whether economic, and social, that the causes of violations of intellectual property arise. From his own point of view analyzed this issue, I focused mainly on the activities of control authorities in the field of intellectual property rights protection, which helps to improve the situation regarding intellectual property rights.
