Abstract:

Bakalářská práce pojednává o závěti, konkrétně o jejím vývoji od roku 1918 do současnosti. Detailně popisuje možnosti pořízení a podmínky platnosti závěti, způsobilost osoby zůstavitele, dědice a svědka, a v neposlední řadě způsoby zrušení a neplatnost poslední vůle. Většina mé práce je věnována současné právní úpravě závěti, která je, po mnoha novelizacích, platná od roku 1964 až doposud. V předposlední,třetí,kapitole popisuji, jakým způsobem a za jakých podmínek je možno pořídit poslední vůli dle nových pravidel, která by měla vejít v platnost 1. 1. 2014. V závěru je porovnání stávající a nové právní úpravy závěti.

Abstract:

The bachelor thesis deals with the will, specifically about its history from 1918 to the present. It describes in details possibility of acquiring and conditions of will validity, eligibility of the person testator, heir and witness, and last but not least the methods of revocation and invalidity of the will. The most of my work is dedicated to the current will legislation that has been after many amendments valid since 1964 until now. In penultimate, the third charter, I describe how and under what conditions its possible to make the last will according to the new rules which should enter into force since the 1st of January 2014. There is a comparison of existing and new will legislation in the conclusion.
