Shortcomings of Stability and Growth Pact and the New Fiscal Compact

Abstract:

Hlavním cílem práce je analýza nové Smlouvy o stabilitě, koordinaci a vládě v Hospodářské a měnové unii, na kterou se autor pokouší pohlížet prizmatem Paktu stability a růstu - tedy předchozího (avšak nadále platného) dokumentu EU s prakticky totožným účelem. Práce srovnává oba dokumenty z hlediska okolností jejich vzniku, jejich formy a obsahu - zejména povahy konkrétních pravidel a sankčních mechanismů. Hlavní otázkou, kterou si práce klade za to zodpovědět, je, zda nová dohoda skutečně reflektuje hlavní nedostatky Paktu stability a růstu, které způsobily jeho praktické nedodržování, a zda tak má „Fiskální kompakt“ větší potenciál skutečně zajistit fiskální odpovědnost členských států.

Abstract:

Main focus of the thesis is the analysis of the new Treaty on Stability, Coordination and Governance in Economic and Monetary Union. Author looks at this treaty through the lens of Stability and Growth Pact - previous document with very similar functions, which is still in force to this day. Author compares both documents by key issues such as their origins, legal form and contents (especially fiscal rules and sanction mechanisms). The main question, that the thesis tries to answer, is whether or not this new treaty reflects the shortcomings of Stability and Growth Pact, which may have caused its constant violations in the past, and whether or not the new "Fiscal Compact" has better potential to actually secure the fiscal responsibility of member states.
