The Legal and Social Consequences of Personal Insolvency and Related Societal Implications

Abstract:

Resumé V této práci se zabývám problematikou úpadku především fyzických osob v České republice. V první části je vymezen pojem insolvence a pojmenována stěžejní právní úprava a její cíle dle důvodové zprávy k insolvenčnímu zákonu. Dále jsou popsány základní přístupy k insolvenčnímu právu a hlavní cíle insolvenčního řízení. V teoretické části jsou popsány základní pojmy insolvenční problematiky, jako je úpadek, předlužení a insolvenční řízení u kterého je popsán jeho průběh. Další kapitoly se zabývají hlavními způsoby řešení úpadku a zejména institutem oddlužení. Dále se tato práce zabývá podstatnými příčinami úpadku a jsou popsány především sociální dopady, na život takto postižených osob. Následně je řešena ochrana před úpadkem osoby a to zejména v oblastech spotřebitelského práva, finančního vzdělávání osob i procesních úkonů při prodeji finančních produktů ze strany profesionálů. V praktické části je položena výzkumná otázka, která dává odpověď na podstatu problematiky úpadku osob. Pomocí dotazníkové metody jsem položil cílené otázky osobám, které se jako profesionálové zabývají prodejem finančních produktů a poradenstvím v oblasti osobních financí a zhodnotil tak jejich přínos k problematice předlužení osob v ČR. V závěru této práce se zabývám možným návrhem legislativních změn a to zejména v oblasti finanční gramotnosti osob v ČR a legislativou spojenou s dohledem České národní banky na osoby poskytující finanční poradenství a prodej finančních produktů.

Resumé in English In this thesis, I deal with the issue of bankruptcy of mainly natural persons in the Czech Republic. In the first part, the concept of insolvency is defined and the main legal regulation and its objectives are named according to the explanatory memorandum to the Insolvency Act. Then the basic approaches to insolvency law and the main objectives of insolvency proceedings are described. In the theoretical part, the basic concepts of insolvency, such as bankruptcy, over-indebtedness and insolvency proceedings are described. Other chapters deal with the main methods of resolving insolvency and in particular the institution of debt settlement. Furthermore, the main causes of bankruptcy are discussed and the main known effects on the lives of those affected are described. Subsequently, the protection from bankruptcy of a person is addressed, in particular in the field of consumer law, financial education of persons and procedural acts in the sale of financial products by professionals. In the practical part, a research question is posed which gives an answer to the essence of this issue. Using the questionnaire method, I asked targeted questions to persons who, as professionals, are involved in the sale of financial products and personal finance advice, to assess their contribution to the problem of personal over-indebtedness in the Czech Republic. In the conclusion of this thesis, I discuss possible legislative changes, especially in the area of financial literacy of persons in the Czech Republic and legislation related to the supervision of the Czech National Bank on persons providing financial advice and selling financial products.
