Abstract:

Téma mé diplomové práce je Úpadek a insolvence firmy. Práce obsahuje teoretickou a praktickou část a je dále dělena na jednotlivé kapitoly a podkapitoly. První kapitola se podrobně zaměřuje na úpadek firmy, jednotlivé pojmy, které se této problematiky týkají a rovněž formy úpadku, které mohou nastat. Druhá kapitola se věnuje insolvenčnímu řízení, moratoriu, projednání insolvenčního návrhu a následně i rozhodnutí o tomto návrhu. Třetí kapitola se soustředí na jednotlivé způsoby řešení úpadku. Detailně je v této kapitole rozebrán konkurz, dále reorganizace a v neposlední řadě oddlužení firmy. V praktické části mé diplomové práce se zaměřuji na obchodní společnost, která se nachází v úpadku a prochází insolvenčním řízení. V této části podrobně zanalyzuji řešení úpadku reálné obchodní společnosti, která se již v úpadku nachází a vstupuje do insolvenčního řízení. V první řadě půjde o obeznámení s danou obchodní společností, zjištění, které krizové hrozby a signály úpadkového stavu u společnosti nastaly. Tyto fakta budu zjišťovat na základě účetních výkazů a dalších dokumentů. Následně zjistím, jaké byly důvody, proč se společnost do této situace dostala a navrhnu opatření, které by společnost mohla případně realizovat, aby se vyvarovala úpadku.

Abstract:

The topic of my thesis is Bankruptcy and insolvency of the company. The work includes theoretical and practical part and is subdivided into chapters and subchapters. The first chapter focuses in detail on the company's bankruptcy, the individual concepts that relate to this issue and also forms of bankruptcy that may occur. The second chapter deals with insolvency proceedings, moratorium, insolvency discuss and the subsequent decision on the proposal. The third chapter focuses on the different ways of resolving insolvency. In detail in this chapter is broken down bankruptcy, further reorganization and finally debt relief companies. In the practical part of my thesis i focus on a company that is in bankruptcy and undergoing insolvency proceedings. In this section i analyze the decline of real business solutions company, which is already in decline and enters into insolvency proceedings. First of all, it will be familiar with the company, finding that crisis and the threat of bankruptcy status signals from occurring. These facts I will collect on the basis of the financial statements and other documents. Then find out what were the reasons why the company is in this situation and suggest measures that the company might eventually realize to avoid the bankruptcy.
