Operational search means with a focus on monitoring persons and things according to §158d of the Criminal Code

Abstract:

Operativně pátrací prostředky představují soubor nástrojů a opatření, které se využívají za účelem předcházení, odhalování, objasňování a dokumentování trestné činnosti. Cílem diplomové práce je na základě analýzy terénní práce kriminalisty navrhnout efektivní soubor opatření, který eliminuje nejčastější chyby policistů při použití operativně pátracích prostředků, zejm. sledování osob a věcí. Hlavní výzkumnou metodou je terénní výzkum, jehož úkolem je identifikovat rozhodující faktory ovlivňující práci kriminalisty, který ve výkonu aktivní služby využívá operativně pátracích prostředků dle §158d trestního řádu. Výstupem práce ‚je soubor poznatků a návrh opatření řešící odstranění negativních faktorů, které ovlivňují práci kriminalisty sledovače v terénu.

Abstract:

Operational search means are a set of tools and measures that are used for the purpose of preventing, detecting, clarifying and documenting criminal activity. The aim of the diploma thesis is to propose an effective set of measures, based on the analysis of the field work of the criminologist, which eliminates the most common mistakes made by police officers when using operational search means, especially the monitoring of people and things. The main research method is field research, the task of which is to identify the decisive factors affecting the work of a criminal investigator who, in the course of active service, uses operational search means according to §158d of the Criminal Code. The output of the work is a set of findings and a proposal for measures addressing the elimination of negative factors that affect the work of a criminologist in the field.
