Criminal Law Protection of Public Officers

Abstract:

Téma této diplomové práce je „Trestněprávní ochrana úřední osoba, práce je rozdělena do šesti kapitol, nepočítaje úvod a závěr. Druhá kapitola se zbývá historií trestního zákona od vzniku Československa do současné doby, dále je v třetí kapitole definován trestný čin, co je to vlastně skutková podstata trestného činu a jeho vývojová stádia, ve čtvrté kapitole, kde je konkrétně vymezen pojem „veřejného činitele“, podle tehdejší platné právní úpravy trestního zákona v návaznosti na současně platný trestní zákoník, který již nahrazuje pojem veřejného činitele „úřední osobou“ s rozepsáním, kdo konkrétně je z hlediska současné platné právní úpravy. Pátá kapitola podrobně analyzuje vybraná trestněprávní ustanovení určených na ochranu osob obsažených zejména v hlavě X zvláštní části trestního zákoníku s odkazem na současnou a již ustálenou judikaturu Nejvyššího soudu vztahující se k této oblasti. Tato část je ukončena šestou kapitolou ukazující nové možné směry o trestněprávní ochraně úřední osoby de lege ferenda. V závěru práce zde jsou uvedeny statistické údaje z kriminologického hlediska, vedené policejním prezidiem, týkající se napadání úředních osob (včetně záchranářů) za dobu platnosti nového trestního zákoníku tedy od 1. ledna 2010 až do současné doby a to konkrétně napadení úřední osoby a úplatkářství.

Abstract:

Theme of this diploma work is „Criminal Law Protection of Public Officers“. The work is dividend into 6 chapters, excluding the introduction and the conclusion. The second chapter focuses on the history of criminal law since the birth of Czech till the present. The third chapter definer the criminal act and also what merits are. In the fourth chapter, which is specifically defined the term "public officers" under the then applicable rules of criminal law in connection with currently applicable Criminal Code, which has replaced the concept of a public official to "public officers" in itemising exactly who is currently in force in terms of legislation. The fifth chapter analyzes in detail the selected penal provisions designed to protect people especially contained in Title X of the Special Part of the Penal Code with reference to the current and already well-established Supreme Court case law relating to this area. This part is finished sixth chapter showing new possible directions on the protection of public officers on legal aspects. In conclusion there are the statistics from the criminological point of view, led by Police Presidium, concerning abuse of public officers (including paramedics) for the duration of the new Criminal Code, since 1. January 2010 till the present time and specifically attacked officials and bribery.
