Protection of the Environment in Czech and Foreign Law through the Criminal Law

Abstract:

Tato diplomová práce se zabývá trestněprávní ochranou životního prostředí. V prvních dvou kapitolách je vymezena ochrana životního prostředí v České republice obecně. Třetí kapitola se věnuje mezinárodní a evropské ochraně životního prostředí,jelikož to tvoří základ české právní úpravy. Další část diplomové práce je již v rovině trestněprávní a zahrnuje trestněprávní odpovědnost, trestněprávní ochranu životního prostředí v České republice a trestněprávní ochranu životního prostředí v zahraničí, konkrétně v Německu a Polsku. Poslední sedmá kapitola shrnuje úvahy de lege ferenda v dané právní oblasti.

Abstract:

This diploma thesis focuses on the criminal protection of the environment. In the first two chapters is discussed the protection of the environment in the Czech republic in general. Third chapter summarizes the international and European protection of the environment. This chapter is important because the Czech law is based on the international and European law. The next part of the thesis is focused mainly on the criminal law. To be concrete, criminal liability, criminal protection of the environment in the Czech republic and criminal protection of the environment in foreign countries (Germany and Poland). The last seventh chapter contains reflections for the future and possible changes that could be done.
