Abstract:

Tato práce se zabývá problematikou ochrany výstupů umělé inteligen-ce, jmenovitě autorským právem a právy souvisejícími s autorským právem. V obecné části je představena technická stránka umělé inteli-gence, hlavní důraz je položen na aspekty, které odlišují umělou inteli-genci in jiných softwarů. Dále jsou položeny základy, v podobě teore-tického základu kreativity. Dále obecná část obsahuje právní rámce, Evropské unie a České republiky, doplněné o Bernskou úmluvu. Právní rámec se zaměřuje, na postavení diskutovaných právních rámců, k výtvorům umělé inteligence. Následně v praktické části je už přistoupeno ke konkrétním subjektům, které mohou být kvalifikováni jako autoři výtvorů umělé inteligence. Na čtyři hlavní autorské subjekty, navazuje kapitola zabývající se stěžejními teoriemi autorského práva a jejich vliv na umělou inteligenci. Následně jsou nabídnuty alternativní způsoby ochrany výtvorů umělé inteligence. Práce čerpá hlavně ze zahraniční, ale i z české literatury, odborných monografií jakož i soudní judikatury s cílem v závěru najít optimální řešení pro problematiku ochrany výtvorů umělé inteligence na výstupu.

Abstract:

This work addresses the issue of protecting the outputs of artificial intelligence, specifically through copyright law and related rights. The general section introduces the technical aspects of artificial intelli-gence, with primary emphasis on features that distinguish artificial in-telligence from other software. Additionally, foundational concepts of creativity are established in a theoretical framework. Furthermore, the general section encompasses legal frameworks of the European Union and the Czech Republic, supplemented by the Berne Convention. The legal framework focuses on the positioning of the discussed legal structures concerning artificial intelligence creations. Subsequently, in the practical section, attention is directed toward specific subjects that may qualify as authors of artificial intelligence creations. This section discusses four main authorial subjects, followed by a chapter examining pivotal copyright theories and their impact on artificial intelligence. Alternative methods of protecting artificial intelli-gence outputs are then proposed. The work draws extensively from both foreign and Czech literature, specialized monographs, and judicial case law, aiming to find an optimal solution for the protection of artifi-cial intelligence creations.
