Abstract:

Diplomová práce má za cíl přiblížit vnitřní fungování Mezinárodního rozhodčího soudu při ICC a Rozhodčího soudu při HK ČR a AK ČR a u omezeného okruhu vybraných otázek vymezit rozdíly v povaze řízení vedeného dle Rozhodčích pravidel ICC vůči řízení vedeného dle Řádu Rozhodčího soudu při HK ČR a AK ČR. Předmětem zkoumání je především zjištění rozdílů ve vymezených otázkách v případě řízení s mezinárodním prvkem, přičemž vedle zmíněných pravidel vydaných oběma soudy je při posuzování využito i Vzorového zákona UNCITRAL a zákona č. 216/1994 Sb., o rozhodčím řízení.

Abstract:

The aim of the thesis is to present the internal functioning of the International Court of Arbitration at the ICC and the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic and to define the differences in the nature of the proceedings conducted under the ICC Arbitration Rules compared to the proceedings conducted under the Rules of the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic. The object of the examination is pri-marily to determine the differences in the defined issues in the case of proceedings with an international element, whereby, in addition to the aforementioned rules issued by both courts, the assessment is also based on the UNCITRAL Model Law and Act No. 216/1994 Coll., on arbitration proceedings.
