Accessory co-ownership

Abstract:

The contents of the master thesis entitled "Co-ownership of an accessory thing" consists of an analysis of newly-established, within its characteristics of a specific type of ownership, which is concentrated in §§ 1223 – 1235 of a new Civil Code. To achieve this aim, work is based on a brief analysis facing the current comprehension of an co-ownership. The next section is devoted to analyzing the actual co-ownership of accessory thing, in particular the issue of formation, content and termination of this legal relationship. The work also responds to the obligation of registration rights in the property register. Last, but not least, it also adresses the issue of the systematic inclusion in the context of co-ownership. In conclusion, the work responds to the obligation of registration rights in the property register.

Abstract:

Obsahom predkladanej magisterskej práce s názvom „Přídatné spoluvlastnictví“ je analýza novovzniknutého, svojou charakteristikou špecifického druhu spoluvlastníctva sústredeného v §§ 1223 – 1235 nového občianskeho zákonníka. K dosiahnutiu tohto účelu dielo vychádza z krátkeho rozboru súčasného pojatia spoluvlastníctva. V ďalšej časti sa venuje popisu a analýze samotného prídatného spoluvlastníctva, najmä otázke vzniku, obsahu a zániku tohto právneho pomeru. Práca sa tiež snaží nájsť odpoveď na otázku, aký rôzny charakter a vlastnosti môžu veci v prídatnom spoluvlastníctve mať. V neposlednom rade sa tiež zaoberá problematikou systematického začlenenia prídatného spoluvlastníctva v rámci spoluvlastníctva. Záverom dielo reaguje na povinnosť zápisu práva v katastre nehnuteľností.
