The Law of International Investment Protection under the Energy Charter Treaty

Abstract:

The overall objective of this work is to provide the reader with an overview of the process of resolving disputes arising from the provisions of the Energy Charter and the description of the institutes, which is characteristic of this contract. Divided into three institutes and the dispute settlement mechanism, the issue of Investor's Institute and the Institute's investment problem is selected to cover the three most basic institutes of determining not only the procedural aspect of the arbitration, but the overall dispute, which equips its Energy Charter signatories. The reader should work after reading an overview of the problematic passages in each of the mentioned institutes and earned at least a basic argumentative view on individual cases. Scope of this thesis is relatively large, but as was mentioned already in work methods, Energy Charter is a young and very specific institution, and therefore can not offer final answers and solutions arising from the different perspectives of argumentation, or slash them settled law.

Abstract:

Celkovým cieľom práce je poskytnúť čitateľovi prehľad o procese riešenia sporov vyplývajúcich z ustanovení Energetickej Charty a popis inštitútov, ktorými je táto zmluva charakteristická. Rozdelenie na tri základné inštitúty a to mechanizmus riešenia sporov, problematika inštitútu Investora a problematika inštitútu Investície je vybrané za účelom pokryť tri najzákladnejšie inštitúty determinujúce procesnú stránku nielen rozhodcovského konania, ale celkového riešenia sporov, ktorými Energetická charta vybavuje svojich signatárov. Čitateľ by mal po prečítaní práce mať prehľad o problematických pasážach v každom zo spomínaných inštitútov a získal aspoň základný argumentačný náhľad na jednotlivé spory. Záber diplomovej práce je relatívne široký, ale Ako bolo spomínané už v metódach práce, Energetická charta je mladý a veľmi špecifický inštitút, preto nie je možné ponúkať finálne odpovede a riešenia vznikajúcich z rôznych argumentačných pohľadov, ani ich rozseknúť ustálenou judikatúrou.
