The Pledge and Its Execution in Tax Administration from the Customs Office's Point of View

Abstract:

Téma diplomové práce se věnuje otázce zajištění daňového nedoplatku zástavním právem a jeho výkonu z pohledu působnosti a pravomocí orgánů Celní správy ČR vystupujících v postavení správců daně. Jejím cílem je vymezení pojmů, shrnutí postupů, identifikace a charakteristika komplexního procesu při zajištění nedoplatku zástavním právem z pohledu celního úřadu s důrazem na možnosti a způsoby jeho následné realizace. Práce je koncipována tak, že je systematicky členěna krom úvodu a závěru do osmi logicky na sebe navazujících kapitol. První kapitola je věnována vymezení pojmu zástavního práva, jeho obecného významu, také jsou zde analyzovány okamžiky jeho vzniku a účinnosti a vymezeny subjekty tohoto řízení. Druhá kapitola pojednává o předmětech zástavního práva tak, jak je právně upravuje nový občanský zákoník. Třetí kapitola se věnuje institutům jako je veřejný seznam a rejstřík zástav. Následuje kapitola pojednávající o druzích zajišťovaných pohledávek. Pátá kapitola je vymezena samotnému výkonu zástavního práva s obecným uvedením způsobů jeho realizace a postavení zajištěných věřitelů. Kapitola šestá je věnována konkrétním způsobům zpeněžení při výkonu zástavního práva a věnuje se rovněž postavení zajištěných věřitelů v insolvenčním řízení. Sedmá kapitola se věnuje rozvrhovému řízení, jeho obecnému pojetí, průběhu a s ním spojeným účinkům. Poslední kapitola je zaměřena na důvody a okamžiky zániku zástavního práva.

Abstract:

The topic of the diploma thesis is devoted to the issue of securing tax arrears by lien and its performance in terms of scope and powers of the authorities of the Customs Administration of the Czech Republic in the position of tax administrators. Its aim is to provide the definition of concepts, summary of procedures, identification and characterization of the complex process while ensuring the outstanding debt by lien from the point of view of the customs office, with an emphasis on the possibilities and methods of its subsequent implementation. The work is designed so that it is systematically divided in addition to the introduction and conclusion into eight logically consecutive chapters. The first chapter is devoted to the definition of the concept of lien, its general meaning, it also analyzes the moments of its origin and effectiveness and defines the subjects of this proceeding. The second chapter deals with the subjects of the lien as regulated by the new Civil Code. The third chapter deals with institutes such as the public list and the register of pledges. The following chapter deals with the types of secured receivables. The fifth chapter is defined by the exercise of the lien itself with a general indication of the methods of its implementation and the position of secured creditors. Chapter six is devoted to specific methods of monetization in the exercise of the lien and also deals with the position of secured creditors in insolvency proceedings. The seventh chapter deals with the schedule procedure, its general concept, course and associated effects. The last chapter focuses on the reasons and moments for the termination of the lien.
