Claims Excluded from Debt Relief

Abstract:

Práce se zabývá pohledávkami vyloučenými z osvobození od placení pohledávek, které bylo dlužníkovi přiznáno po úspěšném splnění oddlužení. V úvodu jsou vymezena základní teoretická východiska oddlužení a institutu osvobození od placení pohledávek. Následně se práce zaměřuje na procesní aspekty vymáhání pohledávek vyloučených z osvobození po skončení insolvenčního řízení. Pozornost je věnována analýze jednotlivých typů těchto pohledávek a související judikatuře, se zvláštním důrazem na pohledávky na náhradu škody způsobené úmyslným porušením právní povinnosti a s tím spojené problematické procesní aspekty.

Abstract:

The thesis deals with claims excluded from the debtor’s discharge from the payment of claims granted after the successful completion of debt relief proceedings. The introductory part outlines the basic theoretical foundations of debt relief and the institute of discharge from the payment of claims. The thesis subsequently focuses on the procedural aspects of the enforcement of claims excluded from discharge after the completion of insolvency proceedings. Particular attention is paid to the analysis of individual categories of such claims and the related case law, with special emphasis on claims for compensation for damage caused by an intentional breach of a legal obligation and the associated problematic procedural aspects.
