Legal framework for post release controls.

Abstract:

Tato diplomová práce se zabývá právním prostředím, které upravuje provádění kontrol po propuštění zboží. Nejprve jsou zde v širších souvislostech popsány skutečnosti utvářející politické a právní prostředí určující tento kontrolní institut a dále současná funkce cla a celních orgánů v Evropské unii. Četnost a výslednost kontrol po propuštění zboží prováděných v České republice pak prokazuje výrazný fiskální dopad do veřejných rozpočtů. V další části se tato práce zabývá konkrétními právními předpisy, které upravují danou kontrolní činnost, a stanovuje jejich hierarchické uspořádání s výlučnou legislativní pravomocí evropské legislativy. Následně jsou použitelná ustanovení právních předpisů představena při praktickém popisu zahájení, provádění a ukončení prováděných kontrol po propuštění zboží. Dále pak tato práce identifikuje případné daňové a trestněprávní dopady na kontrolované subjekty a předkládá některá doporučení těm subjektům, které mohou být touto kontrolní činností dotčeny. Závěr práce je věnován zhodnocení zjištěného stavu a dostatečnosti právního prostředí upravujícího kontroly po propuštění zboží a konkrétním návrhům na úpravu legislativy.

Abstract:

This thesis deals with the legal environment governing the carrying out of post release controls. First, the facts shaping the political and legal environment determining this control institute are described here in a broader context, as well as the current function of customs and customs authorities in the European Union. The frequency and result of post-release checks carried out in the Czech Republic demonstrate a significant fiscal impact on public budgets. In the next section, this work deals with specific legislation that governs a given control activity and sets out their hierarchical arrangement with the exclusive legislative power of European legislation. Subsequently, the applicable provisions of the legislation are presented in a practical description of the start, conduct and end of the post-release checks carried out. Furthermore, this work identifies any potential tax and criminal impacts on the audited entities and makes some recommendations to those entities that may be affected by this control activity. The conclusion of the work is devoted to the evaluation of the established state and sufficiency of the legal environment governing post-release inspections and concrete proposals to modify the legislation.
