Abstract:

Diplomová práce se zabývá problematikou ověřování veřejných listin vydaných v ČR na území cizího státu a ověřováním cizozemských veřejných listin pro jejich použití u nás. Stěžejní úlohou práce je analýza stavu současné právní úpravy ověřování veřejných listin a režimů, které umožňují její použití v mezinárodním prostoru. Kromě úvodního rozboru institutu veřejné listiny je práce zaměřena na relevantní ověřovací mechanismy, které umožňují přeshraniční pohyb veřejných listin a jejich použití. Práce hodnotí ověření veřejných listin v režimech Haagské úmluvy o apostile, bilaterálních dohod, dle nařízení Evropské unie a v prostředí mezinárodního práva soukromého pomocí institutu superlegalizace.

Abstract:

The thesis deals with the topic of authentication of official documents issued in the Czech Republic in the territory of a foreign country and the authentication of official documents issued by a foreign authority for their use in the territory of the Czech Republic. The key aim of the thesis is to analyse the current legal regulation of the authentication process and the regimes enabling its application in an international context. In addition to the initial analysis of what constitutes an official document, the thesis is focused on the relevant authentication instruments that enable the cross-border movement of official documents and the use thereof. The thesis evaluates the authentication process in the regime of the Apostille Convention, bilateral agreements, EU regulations and international private law through the instrument of super legalisation.
