Abstract:

Tato diplomová práce se věnuje velmi aktuálnímu tématu ve světě mezinárodního rozhodčího řízení. Konkrétně se jedná o snahy investorů vyhnout se povinnosti vyčerpat opravné prostředky, která pramení z dvoustranné dohody na ochranu investic uzavřené mezi hostujícím státem a státem investora. V této práci bude vysvětlen původ výjimky z povinnosti vyčerpat opravné prostředky a hlavní pozornost bude věnována relevantní judikatuře. Cílem této práce bude nastínit vývoj výjimky z povinnosti využít opravné prostředky z hlediska složitosti pro investora tento institut využít, dále zda má investor povinnost využít opravné prostředky vždy, a tedy je zde implicitní povinnost argumentovat ve prospěch použití výjimky z povinnosti vyčerpání opravných prostředků v případě, že opravné prostředky nebyly využity, a v neposlední řadě tato práce má být použitelná jak pro investora, tak pro stát a úspěšnou argumentaci v mezinárodním rozhodčím řízení.

Abstract:

This diploma thesis focuses on a well-known topic in international investment arbitration, which is application of the futility exception by an investor to overcome a jurisdictional hurdle, exhaustion of local remedies, arising out of the relevant bilateral investment treaty concluded between the host state and the state of the investor. This diploma thesis explains the origin of the futility exception with an emphasis on the relevant case-law. The aim of this thesis is, firstly, to describe the evolution of the futility exception regarding the threshold that has to be met in order for the investor to successfully argue that it did not need to exhaust local remedies and, secondly, to answer the question whether or not there is a general obligation to exhaust local remedies and there-fore there is an implicit obligation to invoke the futility exception if the local remedies have not been exhausted and, lastly, this thesis should serve as a guide to successfully argue for, in case of an investor, or against, in case of a state, the application of the futility exception in international investment arbitration.
