Socialisation and attitudes of adolescents with educational problems toward social norms in relation to property crimes

Abstract:

Předkládaný výzkum zkoumá koncept právní socializace a postoje adolescentů s výchovnými problémy ke společenským normám (především zákonům), delikventnímu chování (především krádeže, ale jiné projevy antisociálního chování) a autoritám (rodiče, učitelé, rodiče). Právní socializace se dle Fagana a Tylera (2005) skládá ze tří dimenzí, a to institucionální legitimity, právního cynismu a morální neangažovanosti. Výzkum byl proveden kvalitativním přístupem a zúčastnilo se ho celkem 11 respondentů, 9 chlapců a 2 dívky ve věku 15 až 17 let, kteří v době výzkumu pobývali v diagnostickém či výchovném ústavu. S těmi byly provedeny polostrukturované rozhovory a jako doplňující informaci respondenti vyplnili vybrané části dotazníku SAHA. Data byla zpracována pomocí metody tematické analýzy. Z výsledků vyplývá, že adolescenti chápali důležitost pravidel pro fungování společnosti a zároveň odsuzovali většinu projevů antisociálního chování. K vysvětlení jednání v rozporu s jeho odsuzováním používali mechanismy morální neangažovanosti, a to především odvolávání se na okolnosti a sociální kontext. Ve vztahu k autoritám hodnotili nejvíce negativně policii. Na autoritách kritizovali nadměrné zásahy do jejich záležitostí, předpojatý přístup a nadřazené chování. Takovýto přístup snižuje úroveň legitimity, tedy pocitu zavázanosti řídit se zákony a respektovat autority. Naopak kladně hodnotili férový a vstřícný přístup.

Abstract:

The presented research is focused on the concept of legal socialisation and attitudes of adolescents with educational problems toward social norms (especially law), delinquent behavior (thefts but also other displays of antisocial behavior) and authorities (parents, teachers, police). Legal socialisation according to Fagan and Tyler (2005) consists of three dimensions which are institutional legitimity, legal cynicism and moral disengagement. The research was made with qualitative approach and 11 respondents took part in it. These were 9 boys and 2 girls in age between 15 and 17 years who were staying at diagnostic or educational institutions at the moment of the research. Semistructured interviews were made with them and the respondents also filled in chosen parts of the SAHA questionnaire. The research data were processed using thematic analysis. The results show that adolescents understand that rules are important for the society to work and they also condemned most displays of antisocial behavior. To explain their acting in conflict with condemnation of that they used mechanisms of moral disengagement and mostly invoked the circumstances and social context. In relation to authorities the respondents evaluated police as the most negative one. They criticized undue intervention into their issues, prejudiced approach and superioral behavior. This approach lowers the level of their legitimity, which is a sense of obligation to follow the law and to respect authorities. On the other hand they accepted fair and responsive approach.
