Protection of Cultural Monuments in Judgements

Abstract:

Diplomová práce se zabývá analýzou vybraných rozsudků českých soudů v souvislosti s ochranou kulturních památek. Jedná se zejména o rozsudky správních soudů a soudu Ústavního, významnou měrou jsou však, s ohledem na dlouhou dobu účinnosti zákona o státní památkové péči, zastoupeny i rozsudky soudů obecných dle občanského soudního řádu. Práce stručně prezentuje skutkový stav jednotlivých případů, závěry soudů a formuluje obecné principy přenositelné do rozhodovací praxe správních orgánů v dané oblasti. Práce obsahuje pět kapitol – v prvé z nich je uveden stručný přehled relevantní úpravy, druhá pak představuje úvod do problematiky obecného postavení judikatury v českém právním prostředí. Těžištěm práce jsou následující tři kapitoly věnované analýze vybraných rozsudků tříděných dle institutů v rámci tří okruhů – jedná se o téma omezení vlastnického práva v souvislosti s ochranou památek, proces prohlašování věcí za kulturní památky a vztah veřejné správy na úseku ochrany památek a úseku stavebním. Práce vychází ze stavu právní úpravy a odborné literatury k březnu 2012.

Abstract:

This thesis deals with the topic of protection of cultural monuments in judgments of Czech courts. Thesis aims to analyze several chosen judgments issued by Czech courts in cases related to the protection of cultural movements, try to formulate some generally applicable principles and check their impact both on legislative activity and on the activity of administrative bodies on local and regional level. Thesis contains five chapters. First one offers general overview of applicable law, second chapter is dedicated to some notes about the position and importance of judgments in the framework of the system of law in the Czech Republic. The main part of the thesis is represented by the third, fourth and fifth chapter. Each of these three chapters deals with one more specific topic. The third one refers to rulings issued in connection with the negative impact, which the protection of cultural monuments may have on property rights of individuals. The fourth chapter deals with an administrative proceedings resulting in a decision, that given thing or building has to be deemed to be a cultural monument, and managed as such.Finally the last one is dedicated to the relationship between the protection of cultural movements and the building control The thesis is based on a laws applicable and literature existing in March 2012.
