Násilí z nenávisti vůči LGBT

Abstract:

Trestné činy z nenávisti jsou součástí každé společnosti. Nezáleží na tom, zda jsou vedené s rasovým, národnostním, náboženským nebo jiným motivem, všechny do jednoho vyvolávají ve svých obětech pocity studu, strachu a ponížení, založené na příslušnosti k nějaké skupině, kterou ve většině případů nemohou ovlivnit. Tato práce si klade za cíl definování trestného činu z nenávisti založeného na rozdílné sexuální orientaci a představení situací, ve kterých dochází k diskriminaci a obtěžování osob s jinou než heterosexuální orientací. Ukázky konkrétních příkladů znevýhodňování a slovního či fyzického obtěžování byly získány díky polostrukturovaným kvalitativním rozhovorům s 10 zástupci LGBT menšiny z Prahy a okolí. Rozhovory se zabývaly situacemi, názory a postoji respondentů a jejich zkušenostmi s diskriminačními praktikami. Vyplynulo z nich, že s diskriminací a obtěžováním založeným na odlišné sexuální orientaci se setkala většina z nich, a to v případě znevýhodnění především v prostředí zaměstnání nebo školy, v případě obtěžování na veřejných prostranstvích a na internetu. Respondenti incidenty nenahlašují, protože je často považují za málo závažné, případně jim chybí informace o tom, kde je hlásit a také důvěra ve státní aparát.

Abstract:

Hate crimes are a part of every society. It does not matter if they are motivated by race, nationality, religion or anything else, all of them can induce a feeling of shame, fear and humiliation, all based on the victim belonging to a minority, which they in most cases cannot even affect. The main target of this bachelor thesis is to define hate crime based on different sexual orientation and to present situations in which it comes to discrimination and harassment of people with non-heterosexual orientation. The presented cases of disadvantages and verbal and/or physical harassment were acquired through qualitative interviews with 10 LGBT people from Prague and its vicinity. The interviews dealt with situations and opinions of the respondents and their experience with discrimination. They have shown, that most of the respondents were at some point a target of discrimination and harassment because of their different sexual orientation. When talking about disadvantages, it was mostly at work or school, and when talking about harassment, it was most often at public places or on the internet. The respondents usually do not report these incidents because they do not consider them severe, they do not have the information where to report them or they do not trust the authorities.
