Proceedings for a permanent residence permit of a foreigner in the territory of the Czech Republic

Anotácia:

Práce pojednává o právní úpravě cizinecké agendy. Důraz klade na procesní stránku povolování trvalého pobytu cizinců na našem území a na rozbor prostředků ochrany a způsobů přezkoumávání správního rozhodnutí. Zřetel též bere na povinnosti cizince vznikající s vydáním povolení. Vzhledem ke zvláštní procesní úpravě je poukázáno na odchylky od správního řádu, jakož i na odraz cizinecké problematiky v rozhodovací praxi soudů a v činnosti Veřejného ochránce práv.

Abstract:

The thesis deals with the regulation of the foreign agenda. It emphasizes the procedural aspect of allowing the permanent residence of foreigners in our territory and the analysis of the means of protection and methods of reviewing the administrative decision. It also takes into account the obligations of a foreigner arising from the issue of a permit. Due to the specific procedural arrangements, derogations from the Administrative Procedure Code are pointed out, as well as the reflection of foreign issues in the decision-making practice of the courts and in the work of the Ombudsman.
