Subordinated receivables in insolvency proceedings
Abstract:
Novela insolvenčního zákona s účinností od 1. 6. 2019 výrazně rozšířila okruh pohledávek, které se pro účely tohoto zákona považují za podřízené. Následkem změny právní úpravy došlo k významnému nárůstu počtu přihlášek do insolvenčního řízení zahrnujících podřízené pohledávky, a tím také ke vzniku řady problematických aspektů týkajících se výkladu novelizovaného ustanovení. Abstract:
The amendment to the Insolvency Act with effect from 1 June 2019 significantly expanded the range of receivables that are considered subordinate for the purposes of the Insolvency Act.
