Influence Customary Law to the Law of Early Roman State

Abstract:

Disertační práce „Vliv obyčejového práva na právo raného římského státu“ se zabývá okolnostmi, jež měly vliv na formování římského obyčejového práva a způsoby, jakými se promítly do právního prostředí raného římského státu, primárně do zákona XII desek. Z metodologického hlediska využívá právně-antropologických studií pro interpretaci a pochopení některých tematicky zaměřených ustanovení tohoto zákona. Práce se proto zaměřuje na podstatu obyčejového práva jak z římskoprávního, tak z právně-antropologického pohledu ve snaze identifikovat klíčové komponenty právního obyčeje a mechanismy, jež umožňují jeho dynamické přizpůsobování se sociálním změnám v archaických a primitivních společnostech. Podstatná část je věnována technikám a metodám řešení sporů jak v římské společnosti (legisakční řízení), tak v primitivních skupinách (mediace, zprostředkování, rozhodčí a soudní řízení) s důrazem kladeným na společenské faktory, které tento proces ovlivňovaly. V kontextu řešení sporů nezůstávají opomenuty neprávní faktory a vlivy, mezi něž patří v první řadě magie (náboženství), veřejné mínění, kvalitativní úroveň vzájemných vztahů apod. S ohledem na odlišné vnímání magie a její funkce v tehdejší a dnešní společnosti se práce tímto jevem zabývá podrobně, zvláště z pohledu interakce magie a práva. V souvislosti s legisakčním řízením se v neposlední řadě práce zabývá možnými příčinami a důvody, jež vedly ke vzniku bipartity nejstaršího římského procesu, s čímž rovněž úzce souvisí problematika formalismu v raném právu.

Abstract:

The dissertation thesis „Influence Customary Law to the Law of Early Roman State“ deals with the circumstances that influenced the formation of Roman customary law and the ways in which it was reflected in the legal environment of the early Roman state, primarily in the Law of the Twelve Tables. From a methodological point of view, it uses legal-anthropological studies to interpret and understand some of the thematically focused provisions of Twelve Tables. The work therefore focuses on the essence of customary law from both the Roman law and legal-anthropological point of view in an effort to identify the key components of the legal custom and the mechanisms that allow its dynamic adaptation to social change in archaic and primitive societies. A substantial part of thesis is devoted to techniques and methods of dispute resolution both in Roman society (legisactio procedure) and in primitive groups (mediation, mediation, arbitration and court proceedings) with emphasis on the social factors that influenced this process. In the context of dispute resolution, non-legal factors and influences are not left out, such as magic (religion), public opinion, the qualitative level of mutual relations, etc. Given the different perceptions of magic and its function in the then and today's society, the work deals with this phenomenon. in detail, especially from the point of view of the interaction of magic and law. In connection with the legisactio procedure, last but not least, the work deals with the possible causes and reasons that led to the bipartite of the oldest Roman process, which is also closely related to the issue of formalism in early law.
