Hearings of Witness in Criminal Proceedings

Abstract:

Cílem mé bakalářské práce je podrobnější analýza výslechu svědka v trestním řízení. Výslech svědka se řadí k velice důležitým vyšetřovacím úkonům v samotném trestním řízení, jelikož mnohdy pomáhá k detailnímu objasnění vyšetřované události. Je to jedna z nejstarších a poměrně často užívaných metod a používá se ve vyšetřování téměř každého trestného činu. Tato práce je rozdělena do tří stěžejních kapitol, kde na výslech nazírám ze tří důležitých pohledů. Z pohledu trestního práva, kriminalistiky a rovněž forenzní psychologie. Jelikož právě tyto disciplíny výslech svědka nejvíce ovlivňují a přinášejí do jeho vývoje nové poznatky. Aby bylo docíleno kladných výsledků při výslechu svědka, a to získání úplné a věrohodné výpovědi, je zapotřebí mít ve výše uvedených disciplínách alespoň základní znalosti. V první části mé bakalářské práce dávám prostor k definici pojmů a institutů trestního práva procesního, abych tyto fakta mohla v dalších kapitolách prohlubovat. Zaměřila jsem se na stručný historický vývoj výslechu, na jeho místo v procesu dokazování, na osobu svědka, její práva a povinnosti v trestním řízení a na samotný výslech svědka jako důležitý procesní úkon trestního řízení. Ve druhé části poukazuji na kriminalistickou taktiku, která výslech bere jako metodu kriminalistické praxe. Zde jsem rozpracovala jednotlivé fáze přípravy výslechu a jeho stadia. Při výslechu svědka je důležité dodržovat jeho strukturu danou zákonem a nic neopomenout, jelikož při nesplnění zákonem definovaných požadavků by výslech svědka nemohl být brán jako důkazní prostředek v trestním řízení. Třetí část je plně věnovaná psychologickému pohledu na výslech svědka. Zde hraje důležitou roli psychologické působení mezi vyslýchajícím a vyslýchaným, navazování prvního kontaktu a vzbuzování kladné atmosféry při výslechu. Znalost forenzní psychologie pomáhá vyslýchajícímu vhodně komunikovat a analyzovat osobnost vyslýchaného i svoji vlastní, což je přínosem pro objektivní vnímání a vyvarování se chyb při samotném provádění výslechu. Na závěr mé bakalářské práce rozpracovávám problematiku zvláštnosti výslechové praxe členěné podle fyzického stavu vyslýchaného.

Abstract:

The goal of my thesis is detailed analysis of hearings of a witness in a criminal proceedings. Hearings of a witness is considered as a very important part of criminal proceedings, because it often gives detailed clarification in the investigated matter. It is one of the eldest and quite often used methods, that is used in the investigation of almost all criminal offences. This work is divided into three chapters, in which I look at the interrogation in three important perspectives. These are: the criminal law, criminalistics and forensic psychology. It is because these disciplines influence the witness interrogations the most and they bring new information and its progress. To make sure you arrive at positive conclusions in the witness interrogation, which means truthfull and complete statement. It is imperative to have at least basic knowledge in the above disciplines. The first part of my work I use for the definition of terms and institutions of criminal law used, so I can explain these facts deeper in later chapters. I concentrated on a brief historical progress of interrogation, its place in the process of consiction, on the witness, its duty and rights in the criminal proceedings and on the actual witness hearings as an important part in criminal procedure. In the second part, I refer to criminalistics, that take interrogation as part of practical criminalistic work. I worked on separate stages of preparation of the interrogation. It is very important to follow the structure of witness interrogation stated by law and not to forget anything, otherwise if the demand given by law are not met, the witness interrogation and its result could not be taken as an evidence in the actual criminal proceedings. The third part is fully concentrated on psychological aspect of the witness interrogation. In here, the key role is psychological relationship between the examiner and the interrogated, the initial first contact and creating positive atmosphere during interrogation. Knowledge of forensic psychology helps the interrogating officer appropriately communicate and analyze the personality, which is a positive for an objective understanding and to make sure, no mistakes are made in the actual process of investigation. At the end of my work I look at the problematic differencies in the interrogation routine that is focused on physical state of the witness.
