Abstract:

Diplomová práce pojednává o problematice transplantologie. Kromě historie transplantací, bioetiky a souvislostmi s náboženským právem, obsahuje zejména současnou právní úpravu na území České republiky, její organizaci a srovnání s vybranými světovými právními úpravami. Podstatou práce je však poukázat na současné nedostatky Zákona č. 285/2002 Sb., o darování, odběrech a transplantacích tkání a orgánů a o změně některých zákonů,zvláště pak v oblasti mezinárodní spolupráce a kontroverzní ustanovení §11 odst. 4, o odběru orgánů od zemřelých cizinců.

Abstract:

This diploma thesis endeavors to provide readers with the complex understanding of the issue of transplantations. Besides the history of transplantation and bioethics and consequences with the religious law, it deals with current legislative adjustment in the Czech Republic and its comparison with the international legislative. The essential part of the thesis points out to deficiencies of Transplantation Act, especially in the context of an international cooperation and the contradictory provision of § 11, section 4.
