Position of the State prosecution in a criminal procedure de lege lata de lege ferenda

Abstract:

The view of the position of the public prosecution body in the Czech Republic has significantly changed over the last almost thirty years, despite of the fact that the last fundamental change in the Act on the Public Prosecutor's Office took place at the beginning of the millennium. This thesis analyzes the changes which have been done and the proposals submitted, on the basis of which it is possible to define the current position of the public prosecutor's office and thanks to which it is possible to estimate its position in the near future. This thesis also presents alternative options for amending the law in the future.

Abstract:

Pohľad na postavenie orgánu verejnej žaloby v Českej republike sa za posledných takmer tridsať rokov výrazne modifikoval a to aj napriek tomu, že posledné zásadné zmeny v zákone o štátnom zastupiteľstve sa udiali ešte na začiatku milénia. Práca analyzuje vykonané zmeny a predkladané návrhy, na základe ktorých je možné definovať súčasné postavenie štátneho zastupitelstva, a vďaka ktorým je možné odhadovať jeho postavenie v najbližšej budúcnosti. Práca taktiež uvádza alternatívne možnosti úpravy zákona do budúcnosti.
