Tax Control of Koruna Bonds

Abstract:

Bakalářská práce se zabývá korunovými dluhopisy, které byly v České republice emitovány především ke konci roku 2012 a dodnes probíhá jejich prověřování finanční správou. Cílem je analyzovat rozsah a dopad kontrolní činnosti správce daně u emitentů korporátních korunových dluhopisů. Data byla získána z analytické sestavy, která byla finanční správou vytvořena za účelem informování veřejnosti. Z kontrolní činnosti vyplynulo, že v souvislosti s emisí korunových dluhopisů došlo u stovek daňových subjektů k porušení ustanovení ZDP, která upravují daňovou uznatelnost nákladů. Celkem u 47 z nich identifikoval správce daně zneužití práva. Z dat bylo také zjištěno, že na základě provedených kontrolních postupů byla doposud doměřena daň z příjmu právnických osob v celkové výši přesahující 2,7 mld. Kč a zároveň došlo celkově ke snížení daňové ztráty o více než 500 mil. Kč.

Abstract:

Subject of the Bachelor’s thesis is the issuance of bonds with a nominal value of 1 CZK („koruna“ bonds) in the Czech Republic, mostly by the end of the year 2012, and their ongoing investigation by the Czech Financial Administration. The goal of the thesis is to analyze the scope and impact of tax administrators’ audit activities concerning the issuance these bonds. The data used in the analysis was obtained from a dataset created by the Financial Administration to inform the public. The audit activities revealed that, in the context of the aforementioned bonds, hundreds of tax subjects violated the Income Tax Act, specifically the provisions concerning the tax deductibility of costs. Law abuse was identified by the tax administrators in 47 cases. The data also revealed that the tax subjects were charged an additional sum of 2.7 billion CZK during the tax adjustment procedure to date. Similarly, the overall tax loss was decreased by more than 500 million CZK as a direct result of the audit activities.
