Law and Literature Movement in the late 20th and early 21st century

Abstract:

Tato disertační práce se zabývá citacemi krásné literatury v právním odůvodňování. Jejím cílem je prozkoumat, jak jsou tyto citace používány v soudní praxi. Důraz je přitom kladen na otázku jejich přesvědčivosti. První kapitola práce podává přehled současné situace v oblasti hnutí Law and Literature, a to jak ve světě, tak v České republice. Obsahuje také přehled teoretických zdrojů zaměřených na argumentaci krásnou literaturou. Druhá kapitola zkoumá způsoby, jimiž citace krásné literatury používaný českými soudy a Soudním dvorem Evropské unie. Tato kapitola obsahuje také stručné srovnání těchto praktik v České republice a před Soudním dvorem Evropské unie. V poslední kapitole jsou výsledky empirického výzkumu interpretovány z rétorického a právně-sociologického hlediska. Cílem této práce je ukázat, že citace literárních fikcí v soudním odůvodnění může zvýšit jeho přesvědčivost.

Abstract:

This thesis deals with the citations of literary fictions in legal reasoning. It’s aim is to explore how are the citations of literary fictions used in the judicial practice. Persuasiveness of the use of these citations is emphasized. First chapter gives an account of the current situation of the Law and Literature movement, both worldwide and in the Czech Republic. It also provides an overview of theoretical sources focused on argumentation by literary fiction. Then the second chapter explores the ways in which the citations by literary fictions are used by the Czech courts and by the Court of justice of the European Union. This chapter provides a brief comparison of these practices in the Czech Republic and before the CJEU. In the last chapter, results of the empirical research introduced in the second chapter are interpreted from the rhetorical and socio-legal point of view. The goal of this thesis to to show that the citations of literary fictions in the judicial reasoning can make the reasoning more persuasive.
