Amnesty and Pardon in Terms of Constitutional Law

Abstract:

Diplomová práce se zaměřuje na problematiku amnestií a milostí v ústavním právu. Kromě vymezení obou pojmů včetně forem, společných a odlišných znaků je v práci nastíněn také jejich historický vývoj. Práce se převážně věnuje právní úpravě těchto institutů v českém právním řádu, součástí práce je však také pojednání o úpravě amnestií a milostí v jiných státech. Součástí práce jsou také problematické otázky s těmito instituty spojené, jako jsou odpovědnost či možnost soudního přezkumu amnestií. Cílem této práce je pak podat ucelený přehled o otázce právního pojetí amnestie a milosti.

Abstract:

This diploma thesis focuses on the issues of amnesty and pardon in terms of con-stitutional law. Determination of both terms, their forms, similarities and differen-ces is provided, including their historical development. The thesis deals with the legal basis of these institutions within the Czech legal system, however, an outline of amnesties in other countries is included as well. The work also contains the problematic questions connected to these institutions, such as liability or possibili-ty to ask for a judicial review of amnesties. The aim of the thesis is thus to provide a general overview focusing on the question of legal approach to amnesty and pardon.
